When a permit is required
Permit triggers and exempt work for Montgomery County
A building permit is required for any new structure 10 feet x 10 feet (100 sq ft) or larger, new home construction, additions or structural modifications to existing buildings, portable carports, electrical/plumbing/HVAC/mechanical system installations or modifications, and demolition of structures.
- Exempt Agricultural buildings (subject to filing an agricultural use affidavit; floodplain compliance is mandatory)
- Exempt Fences
- Exempt Decks
- Exempt Swimming pools
- Exempt Gazebos
- Exempt Picnic shelters
- Exempt Open porches
Note: Portable carports are expressly NOT exempt—a permit is required. Agricultural/farm structure exemption per Mississippi Code § 17-2-7 does not apply to floodplain management ordinances; full NFIP compliance is mandatory if the property is in a FEMA Special Flood Hazard Area.
