When a permit is required
Permit triggers and exempt work for Oak Bluffs
A building permit is required for all construction within the Town of Oak Bluffs except as exempted by 780 CMR 105.2.
- Exempt One-story detached accessory structures (sheds, playhouses, similar) up to 200 square feet (note: Oak Bluffs uses 200 sq ft, which is larger than the 120 sq ft in 780 CMR 105.2; confirm with department)
- Exempt Fences not exceeding 7 feet in height
- Exempt Retaining walls under 4 feet high
- Exempt Sidewalks and driveways
- Exempt Prefabricated pools less than 24 inches deep
- Exempt Playground equipment and swings
- Exempt Window awnings projecting 54 inches or less without additional support
- Exempt Painting, wallpapering, tiling, and carpeting
- Exempt Cabinet and countertop installation and similar finish work
- Exempt Decks not exceeding 200 square feet in area, not more than 30 inches above grade, when unattached to dwelling and not serving required exit doors
Note: All standard 780 CMR 105.2 exemptions otherwise apply. Exemptions from building permits do NOT exempt work from trade permits, Conservation Commission jurisdiction, or Historic Commission review.

- Workers' compensation insurance certificate or affidavit of exemption
- CSL (Construction Supervisor License) or HIC (Home Improvement Contractor) number, or Homeowner Exemption Affidavit
- ASSESSOR AND TAX COLLECTOR SIGN-OFFS (unique requirement: must be obtained in person at Town Hall before submitting to building department)
- ConCom Order of Conditions (if near wetlands)
- OBHC or MVC approvals as applicable
- Payment: cash or check payable to Town of Oak Bluffs
- Building code
- 780 CMR (Massachusetts State Building Code, 10th Edition effective October 11, 2024)
- Permit validity
- Must commence construction within 6 months of issuance. Work may lapse if suspended for 12 months.
- Owner-builder
- Homeowners of a 1- or 2-family primary residence may pull permits without a CSL or HIC license but must file a Homeowner Exemption Affidavit and assume full contractor liability.
- Contractor requirements
- Contractors must hold a valid CSL (structures over 35,000 cf) or HIC registration for smaller residential work. Separate licensed contractors required for electrical, plumbing, and gas work (homeowners may pull own electrical permit only).

Application process
Typical processing: 1-2 weeks for simple projects (replacements, minor work); 2-3 weeks for typical projects; 3+ weeks for complex projects. Add 2-3 months if a zoning special permit or variance hearing is required. MVC DRI projects add 2-4 months.
- 01 Verify zoning compliance with Oak Bluffs Zoning Bylaws; confirm permitted use and dimensions.
- 02 If demolishing pre-1916 structure, notify Oak Bluffs Historical Commission (OBHC); demolition may be delayed up to 6 months if structure deemed 'significant.' OBHC meets 3rd Wednesday of each month at 3:00 PM.
- 03 If work in or near Wesleyan Grove / Martha's Vineyard Camp Meeting Association (MVCMA) National Historic Landmark District, obtain Architectural Review Committee approval from MVCMA separately.
- 04 Obtain Conservation Commission Order of Conditions if work is within wetland buffer zone (typical 100-foot buffer from regulated resource area).
- 05 Refer large-scale projects to Martha's Vineyard Commission (MVC) before town action if they meet DRI thresholds.
- 06 Obtain Assessor and Tax Collector signatures at Town Hall (56 School Street) before submitting permit application. This step must be completed in person and is UNIQUE to Oak Bluffs among Dukes County towns.

- 08 Fire Department and Board of Health review may add 1-2 weeks to timeline for certain projects.
