When a permit is required
Permit triggers and exempt work for Allegany County
A Land Use Permit must be obtained before starting any land development. All new construction with a footprint larger than 100 sq ft requires a permit, including prefabricated structures. Projects over 600 sq ft undergo full building permit plan review, inspections, and CO issuance. Permit triggers include residential, commercial, industrial, institutional, grading with heavy equipment, mining, commercial timber operations, recreation, waste disposal, utilities, and salvage or junk yards.
- Exempt New construction with footprint of 100 sq ft or less (though code provisions may still apply and land use regulations must be checked)
- Exempt Earth disturbance under 5,000 sq ft may be exempt from stormwater/grading permit trigger (but building code still applies)
- Exempt Decks under 600 sq ft and under 30 inches above grade without a roof system (land use permit may still be required)
- Exempt Renovations of pre-code structures in good standing with no infractions generally do not require a building permit

- Site plan on 8.5 x 11 white bond or graph paper showing property lines, lot size, streams, drainways, slopes, streets, utility lines, existing structures, north arrow, and scale
- For projects over 600 sq ft: full construction drawings including title, all four elevations, floor plan, foundation design, typical cross-sections, materials list and specifications
- Owner name, contractor name, contractor license number, MHIC number, Maryland AG Office General Contractor number
- Master electrician and plumber credentials
- Estimated monetary project value
- Tax map, parcel, and lot numbers; deed information (Liber/Folio); lot/parcel dimensions
- Driveway access type; water and sewer service details
- Sediment/erosion control plan for disturbance over 5,000 sq ft or 100 cubic yards
- Stormwater management documents where required by MDE
- Building code
- The county formally adopted its building code in 1997 (commonly known as the 2007 Building Code of Allegany County, adopting the 2006 IBC and 2006 IRC). However, Maryland state law requires all jurisdictions to comply with the current Maryland Building Performance Standards (MBPS), which adopts the 2021 IBC and 2021 IRC (effective May 29, 2023). The 2020 NEC applies through the State Fire Prevention Code. Local amendments include: 60 lb/sq ft deck live load, 40 lb/sq ft snow load, 8-1/4 inch max riser height / 9 inch min tread depth, NFPA 13D sprinklers, Maryland Accessibility Code, and Allegany County Plumbing Code.

- Owner-builder
- Owner-builder exemption provisions should be confirmed directly with Land Development Services.
- Contractor requirements
- Contractor license number, MHIC number (for home improvement work over $100), and Maryland AG Office General Contractor number required. Master electrician and plumber credentials required for trade work. Maryland home builder registration required for new residential construction.
Application process

- 01 Determine whether the project needs a Building Permit, a Land Use Permit (LUP), or both. Standard building permits are issued as a combined two-permit approach as of January 1, 2025.
- 02 If uncertain whether a permit is required, contact Land Development Services (301-777-5951) or submit drawings for evaluation.
- 03 Download the Land Use Development Permit Application from the county website and gather all required documents and drawings.
- 04 Create a Cloudpermit account and submit the application along with all required documents through the portal at https://us.cloudpermit.com/login.
- 05 Pay all required fees in full at the Allegany County Tax and Utilities Office, second floor, County Office Complex, 701 Kelly Road, Cumberland.
- 06 After fee payment, the permit application is distributed to review agents. For projects requiring building plan review, the Building Safety Office reviews drawings.
- 07 Once approved, download the issued permit and permit placard from Cloudpermit. Post the permit placard and approved plans on the job site.
- 08 Arrange required inspections with the county's third-party inspection agencies before construction progresses beyond each phase.
- 09 Upon completion, arrange final inspection and obtain Certificate of Occupancy (CO) for applicable projects.

Construction may not continue beyond any phase until inspection has been conducted and passed.
