When a permit is required
Permit triggers and exempt work for Prestonsburg
New construction, additions of 30 square feet or more, structural remodels, storage buildings, swimming pools, decks, fences, portable buildings larger than 200 square feet, and site-built garages.
- Exempt Commercial portable buildings under 120 square feet left on their runners and not attached to a pad
- Exempt Residential portable buildings smaller than 200 square feet (but site-built garages and other accessory structures require permits)
Note: Decks, fences, and similar small improvements must be cleared with the building department before construction. Contact the Building & Construction office for clarification on boundary cases.
- Completed permit application
- Two sets of construction plans
- Site plan showing lot boundaries, existing buildings, parking, easements, setbacks, and north arrow
- Plumbing approval from the appropriate authority
- Utility tap paperwork (gas/water/sewer as applicable)
- Building code
- Kentucky Building Code and all referenced ICC codes (building, fire, HVAC, plumbing, solar, existing buildings, etc.) with local amendments.
- Permit validity
- Construction is prohibited until the permit is issued. A Certificate of Occupancy is required before the structure is occupied.
- Owner-builder
- Owners and contractors are responsible for keeping debris contained, managing erosion, and preventing mud from entering paved streets.
- Contractor requirements
- Electrical permit forms request contractor license and master electrician details. General building applications require occupational license and insurance statements.

- 01 Secure the appropriate Building & Construction application (new construction, commercial, sign, electrical, etc.) from the city documents page.
- 02 Gather two complete plan sets, a detailed site plan, and utility approvals (plumbing approval, gas/water/sewer tap paperwork).
- 03 Submit the completed application, site plan, plumbing approval, and separate utility documents with the appropriate fees at City Hall between 8:30-11:00 AM or by appointment.
- 04 Wait for the department to review the plans and issue the permit; an assigned house number will be provided before construction begins.
- 05 Schedule the required inspections through the building office.
- 06 Obtain a Certificate of Occupancy prior to occupying the structure.
