When a permit is required
Permit triggers and exempt work for Harlem
A permit is required for most modifications to property, including fences and accessory buildings. In most cases a building permit is needed so state-mandated inspections can be performed. Working without a permit can result in a $500 fine.
- Exempt Fences not over 7 feet high (though Harlem still requires fence review and a drawing to confirm placement)
- Exempt Retaining walls not over 4 feet high measured from the bottom of the footing to the top of the wall and not impounding hazardous liquids
- Exempt Painting, papering, and similar finish work
- Exempt Ordinary repairs to gutters, decking, and trim work
- Exempt Swings and other playground equipment accessory to detached one- and two-family dwellings
- Exempt Replacement of windows in single-family homes unless in a historic district
- Exempt Stopping leaks in drains, water, soil, waste, or vent piping, unless concealed piping must be replaced with new material
- Exempt Clearing stoppages or repairing leaks in pipes, valves, or fixtures, and replacing water closets, so long as valves or pipes are not replaced or rearranged
- Exempt Removal of trees from private property less than 1 acre and not within a historic district, subject to erosion-control requirements and exceptions
