Application Process
- Confirm permit type and whether parallel county approvals are needed for zoning, environmental, Chesapeake Bay Preservation, floodplain, historic review, land disturbance, or fire review.
- Download the correct county application packet and checklist from the residential or commercial permit page. Complete all required fields; the county instructs applicants to enter N/A where a field does not apply.
- Assemble required documents. For most permits this includes the application, plans, supporting forms, valuation, and trade or contractor information. Residential and commercial packets also reference county electronic submittal rules.
- Submit the package with required deposits and processing fees. Over-the-counter, home occupation, and accelerated permits may be submitted by email; all other submissions must follow the electronic submittal guidelines and be delivered physically.
- County staff routes the application through Permit Center intake and the applicable building, zoning, environmental, and planning reviewers. Corrections or missing items are returned to the applicant for revision and resubmittal.
- Monitor status in eTRAKiT, but do not pay online merely because status shows approved. The county states final fees are not fixed until the permit-ready email is sent.
- After final approval, pay outstanding fees, receive the permit and approved plans electronically, and keep a paper copy of the approved plans, construction documents, and permit card on site for inspections.
Typical processing time: No single county-wide public review-time promise found. The county warns that high permit volume can delay reviews.
General Requirements
The county states a building permit is required to alter, construct, convert, demolish, enlarge, or repair a building or structure in Spotsylvania County, and permits are also required for installation of fuel, oil, gasoline, and bottled gas tanks. Permits are required before work begins.

- Permit validity
- Under the Virginia USBC, permit applications are deemed abandoned after six months if not pursued in good faith or issued. Issued permits may be revoked if work is not commenced within six months or is suspended or abandoned for six months. The county fee schedule also states permit applications awaiting issuance or additional information are voided after six months and deposits are forfeit. For new detached single-family dwellings, additions, and residential accessory structures, the USBC allows a three-year completion limit if imposed by the building official.

- Spotsylvania County administers the Virginia Uniform Statewide Building Code.
- Owner-builder
- Spotsylvania states landowners performing their own work should list themselves in the applicable applicant fields. The county also states that if land is owned as an LLC, the owner must hire licensed contractors and may not perform the work personally.
- Contractor requirements
- Virginia DPOR licensing applies under the USBC. The county application page says LLC-owned projects must use licensed contractors. The Virginia USBC also requires proof of state licensure or a written statement of exemption before permit issuance, plus proof that required local taxes or license fees have been paid.
Fees
- Minimum permit fee
- Common minimums include $285 for new residential single-family and residential additions/accessories with plan review; $180 for many commercial building and plan review lines; $100 for many over-the-counter residential trade permits; and an $80 Permit Center processing fee generally applies.
- Plan check fee
- Many building fees include plan review in the stated fee. Examples include residential single-family homes and additions/accessories at $0.57 per square foot including plan review. Separate plan review lines also appear for commercial new construction, amendments, and fire protection review.
- Permit fee formula
- Mixed schedule. Residential new construction and many additions/accessories are charged per square foot and include plan review. Commercial work uses occupancy-group factors, square-foot formulas, and flat-fee trade lines. Separate zoning, environmental, and planning fees may apply.
- Reinspection fee
- $100
- Penalty (no permit)
- $300 for notice of violation fee for failure to obtain required permit; $300 stop work order; $300 notice to comply
- Payment note
- Deposits and processing fees are due at submission. The county says the intake processing fee is nonrefundable, refunds may be discretionary early in review, and an administrative closure fee of $100 may apply. Debit and credit card payments add a 2.70% surcharge. Checks are payable to Spotsylvania County Treasurer.
Fees change. Verify current amounts at the official fee schedule (effective July 1, 2025).
Work That Does NOT Require a Permit
- Low-voltage wiring and equipment meeting USBC exemption criteria.
- Certain small detached accessory structures within USBC exemption limits.
- Certain tents and air-supported structures within USBC exemption limits.
- Certain shallow and small swimming pools within USBC exemption limits.
- Replacement of above-ground LP-gas containers of the same capacity in the same location using the same piping.
- Ordinary repairs and finish work that the USBC exempts, such as paint, wallpaper, floor finishes, cabinetry and trim in place, and limited nonstructural repair categories.
Important: Historic districts, floodplain areas, Chesapeake Bay Resource Protection Areas, zoning rules, and environmental rules can still require county approval even where the building permit itself is exempt.
