Application Process

  1. Contact Planning and Zoning staff and download the appropriate application, such as the Zoning Location Permit or Zoning Occupancy Permit form.
  2. Submit the completed form with the required plat, plan, and or specifications to the Zoning Administrator.
  3. Obtain any other needed local approvals triggered by the project, such as Historic District review, Planning Commission review, Board of Zoning Appeals action, or Town Council action for special-use matters.
  4. Once the town zoning permit is approved, apply to Loudoun County for the building permit if the work requires county building approval.
  5. Obtain a zoning occupancy permit before commencing the approved occupancy or use where applicable.

Typical processing time: No general administrative permit turnaround was posted. For special use permits, the Planning Commission submits its recommendation within 30 days of the public hearing and Council acts within 60 days after the hearing.

General Requirements

Middleburg zoning permits are required before a use is substantially changed, substantial clearing, grading, or excavation begins, or buildings or other substantial structures are constructed, erected, moved, or substantially altered.

Permit validity
The zoning permit form and Article V state zoning permits expire within 1 year if work or the approved use has not commenced; if work is suspended for 1 year, the permit also expires. The administrator may extend for periods not exceeding 6 months before expiration if conditions are met.

Town zoning review is under the Middleburg Zoning Ordinance; building permits are handled by Loudoun County under the 2021 Virginia Construction Code / USBC.
Owner-builder
The forms allow the owner or authorized agent to sign and request the permit.
Contractor requirements
Virginia DPOR licensing applies to the county-issued building permit side; Middleburg businesses also need town business licensing where applicable.
