Hampshire County, Massachusetts Building Permits

Hampshire County, located in the Connecticut River Valley (Pioneer Valley corridor) of western Massachusetts, spans eight jurisdictions with varying permit processes and portal systems. All municipalities operate under the Massachusetts State Building Code (780 CMR), which transitioned from the 9th Edition (2015 IBC/IRC) to the 10th Edition (2021 IBC/IRC) on July 1, 2025.

Key County-Wide Requirements

  • 780 CMR (Massachusetts State Building Code): All construction, reconstruction, alteration, repair, removal, or demolition requires a permit. Permit must be posted visibly at job site.
  • Commencement deadline: Work must commence within 6 months of permit issuance or permit lapses. Inactive permits lapse if work suspended for 6 months.
  • CSL (Construction Supervisor License): Required for structural work on buildings over 35,000 cubic feet. Licensed CSL holder must be identified on permit application.
  • HIC (Home Improvement Contractor): Required for residential renovation/repair over $1,000 on 1-4 unit properties. Must be registered with Massachusetts OCABR.
  • Homeowner exemption: Owner of detached 1-2 family dwelling (owner-occupied) may pull permit without CSL and act as own contractor. Assumes full liability for code compliance. Exemption does not extend to electrical, plumbing, or gas permits.
  • Separate trade permits: Electrical, plumbing, and gas require separate permits by respective MA-licensed trade contractors. Independent of building permit.
  • Double fees for unpermitted work: If work is started without a permit, fee is doubled in most/all municipalities.
  • 30-day review period: Building official has 30 calendar days from receipt of complete application to approve or deny.
  • Floodplain overlay: Connecticut River valley (Pioneer Valley corridor) spans multiple flood zones. Northampton, Hadley, South Hadley, Easthampton, and Granby have FEMA-mapped SFHA areas. Development requires floodplain management ordinance compliance (elevation to or above BFE, flood-resistant materials). Verify flood zone status via FEMA Flood Map Service Center (msc.fema.gov).

Statewide Exempt Work (780 CMR 105.2)

The following do not require a building permit (trade permits may still apply):

  • One-story detached accessory structures (sheds, playhouses) ≤ 120 sq. ft.
  • Fences ≤ 7 feet in height
  • Retaining walls ≤ 4 feet
  • Water tanks ≤ 5,000 gallons with height-to-diameter ratio ≤ 2:1
  • Sidewalks and driveways ≤ 30 inches above adjacent grade (not over basements/stories)
  • Prefabricated above-ground pools < 24 inches deep and < 5,000 gallons
  • Window awnings projecting ≤ 54 inches from wall
  • Shade cloth, greenhouses, painting, tiling, carpeting, finish work
  • Movable fixtures, cases, racks, counters, partitions ≤ 5 feet 9 inches
  • Playground equipment on 1-2 family residential parcels
  • Temporary theater/TV/motion picture sets

Note: Some jurisdictions have LOCAL RESTRICTIONS more stringent than state baseline (e.g., Ware requires all pools; Granby restricts sheds ≥ 200 sq. ft.). Confirm with local jurisdiction.

Portal Fragmentation Alert

Hampshire County has no unified permit platform. Five different systems are in use:

  • OpenGov/ViewPoint Cloud: Amherst, Ware, South Hadley
  • PermitEyes: Easthampton
  • PermitLink: Hadley
  • CivicPlus-integrated: Granby
  • Paper submission only: Northampton, Belchertown

Applicants must register separately for each portal or submit by mail/in-person. Paper application jurisdictions (Northampton, Belchertown) significantly increase turnaround time.

Critical Data Quality Notes

  • Northampton fee schedule: Fee PDFs are published (effective July 1, 2024) but specific per-$1,000 valuation rates not parsed. Confirm by calling 413-587-1240.
  • Amherst fee schedule: Published schedule dated July 2014 (11+ years old). Fees may have been updated. Confirm with Jennifer Mullins (mullinsj@amherstma.gov).

  • Granby shed threshold: Granby states "sheds 200 sq. ft. or more" require a permit. State baseline exempts sheds ≤ 120 sq. ft. The 120-200 sq. ft. range is ambiguous -- resolve with Building Inspector before proceeding.
  • South Hadley office hours: Not explicitly published on town website. Call 413-538-5030 to confirm.
  • Granby office hours: Part-time schedule (Tue/Thu 4-6 PM as of April 2023) -- confirm current hours at 413-467-7177.
