Permit Authority

Frederick County is a county, not an independent city. The County issues building permits and performs building inspections for unincorporated Frederick County and, in coordination with the towns, also handles building inspections for construction inside Stephens City and Middletown. Winchester is a separate independent city with its own permit authority.

Application Process

  1. Confirm whether the project is residential, commercial, temporary structure, irrigation, or trade-specific, then pull the correct county application packet and checklist.
  2. Assemble the permit application, owner/contractor information, tax map and site location details, setbacks, and project description.
  3. Add prerequisite approvals as applicable: health permit or Frederick Water confirmation, approved site plan, erosion and sediment control or stormwater approval, and zoning compliance review.
  4. Submit plans and supporting documents to the County Inspections Department in person, by mail, or by fax. Online submittal is not available for plan review documents.
  5. County staff route the submission to Planning and Development, Inspections, and Public Works as needed for review.
  6. Respond to comments or requests for additional information.
  7. When approved, schedule issuance and pay permit fees by appointment. Applications are accepted Monday through Friday 8:00 a.m. to 4:30 p.m.; permits are issued Monday through Friday 8:00 a.m. to 3:00 p.m. by appointment only.

General Requirements

A permit is required before construction or demolition of a building or structure, and before most structural, egress, plumbing, mechanical, gas, electrical, fire protection, or occupancy-changing work regulated by the Virginia Uniform Statewide Building Code.

Permit validity
Permits with no activity are void after six months. Renewal is required after one year of inactivity, with renewal fees applicable after the first year.

2021 Virginia Uniform Statewide Building Code (Part I Virginia Construction Code, Part II Virginia Rehabilitation Code, Part III Virginia Maintenance Code), incorporating the 2021 IRC, 2021 IBC family, 2020 NEC, and related Virginia trade codes.
Owner-builder
Owners may act as their own contractor if the DPOR owner-contractor definition is met.
Contractor requirements
Contractors must hold a valid Virginia DPOR contractor license where applicable and proof of county or town business license if applicable.

Permit fee formula
Mostly square-foot and item based. Examples: one- and two-family dwellings at $0.40 per square foot; many commercial structures at per-square-foot rates with $120 minimums; many smaller residential items at flat fees.
Reinspection fee
$75.00 at inspector discretion.
Penalty (no permit)
$75.00 per work hour or portion thereof for work started prior to permit issuance.
Payment note
Permit fees are due at issuance. Accepted payment methods: cash, check, Visa, Mastercard, or Discover. A 2.25% surcharge applies to credit-card payments. All fees are subject to a 2% state surcharge.

Work That Does NOT Require a Permit

  • One-story detached tool or storage sheds and similar structures up to 256 square feet
  • Fences, unless required for pedestrian safety or pool barriers
  • Certain low retaining walls
  • Small shallow pools meeting USBC criteria
  • Certain replacement windows and doors without framed-opening changes
  • Fixture-for-fixture plumbing replacements without system alterations
  • Like-for-like receptacle or light fixture replacements in qualifying residential occupancies
  • Ordinary paint, wallpaper, trim, and flooring work
  • Certain limited reroofing and residing work meeting USBC criteria

Important: These exemptions follow Virginia USBC Section 108.2. Exemptions may be overridden in historic districts or special flood hazard areas. Zoning approval may still be required even when a building permit is not. Confirm with the Frederick County Inspections Department before proceeding.
