Essex County Building and Zoning is the building-permit issuer and building-code inspector for all county territory. Essex County is a Virginia county, not an independent city. The Town of Tappahannock overlaps county permit jurisdiction for zoning, sign, historic-overlay, and business-license review; town zoning can overlay county permit issuance rather than replace it.

Application Process

  1. Confirm whether the project needs a county building permit, a county zoning or land-development permit, a floodplain permit, or multiple approvals. The Building and Zoning office administers plan review, inspection, and certificate-of-occupancy issuance, and the county publishes separate building, erosion and sediment, floodplain, and zoning forms.
  2. Download the correct county form set from the Building Applications and Forms or Zoning Applications and Forms pages. Core forms include the Residential Building Permit Application, Commercial Building Permit Application, Erosion and Sediment Control (Land Disturbing Permit) Application, Floodplain Development Permit Application, and Land Development and Zoning Permit.

Residential and commercial forms require owner and job-site information, scope of work, floodplain status, estimated cost, contractor information, Virginia contractor license numbers or owner affidavit, and trade information. The land-disturbance form requires a full erosion and sediment control plan unless the project qualifies for an Agreement in Lieu.
  4. Submit the application to Essex County Building and Zoning before 4:00 p.m. The county states permit applications must be submitted by 4:00 p.m. so payment can be processed by 4:15 p.m.; applications are not accepted after 4:00 p.m.
  5. County staff reviews the submission. The review period for building permit applications is a minimum of 7 business days. Additional zoning, land-disturbance, Chesapeake Bay, stormwater, or floodplain review may also be required depending on the site.

General Requirements

Essex County administers permits for new construction, additions, alterations, demolition, accessory buildings, manufactured homes, docks, commercial work, trade permits, land disturbance, floodplain development, and zoning or land-development approvals. The floodplain application states a permit is required for any activity or development in a floodplain district. Virginia's 2021 Virginia Uniform Statewide Building Code also requires permits for most construction, demolition, structural work, and many trade installations or changes.

Permit validity
Under the Virginia Construction Code, permits may be revoked if work does not start within 6 months after issuance, or if work is suspended or abandoned for 6 months after commencement. The building official may also set a completion deadline of up to 3 years for certain residential work.
Building code
2021 Virginia Uniform Statewide Building Code, in full effect as of January 18, 2025. Permits issued from that date forward are inspected under the 2021 VUSBC.
Owner-builder
County building permit forms include an Owner's Affidavit for owners doing the work themselves, citing Code of Virginia Section 54.1-1111, requiring either proof of licensure or an affidavit that the applicant is not subject to licensure.
Contractor requirements
County forms require Virginia contractor license numbers for general and trade contractors. Applicants doing work in Essex County may be denied service until proof of an Essex County business license is shown. Virginia DPOR regulates contractor and tradesman licensure at the state level.

  • Detached prefabricated buildings housing private swimming pools not more than 256 square feet
  • Tents or air-supported structures not more than 900 square feet with occupant load of 50 or less
  • Fences of any height unless otherwise required for pedestrian protection or as a pool barrier
  • Retaining walls not over 3 feet of unbalanced fill that do not support surcharge and do not impound certain liquids
  • Water tanks supported directly on grade if capacity does not exceed 5,000 gallons and the height-to-diameter ratio does not exceed 2 to 1
  • Sidewalks and driveways that are not part of an accessible route
  • Decks not exceeding 256 square feet if not more than 30 inches above grade at any point, not attached to a dwelling, and not serving an exit door
  • Many ordinary repairs and limited same-kind fixture or finish replacements listed in the Virginia Construction Code

Important: Exempt from building permit does not mean exempt from zoning requirements. The Virginia Construction Code allows the building official to require permits for some otherwise exempt roofing, siding, and window work in historic districts or flood-hazard areas.
