Permit Authority

Culpeper County is the building permit issuer for unincorporated Culpeper County and for projects inside the Town of Culpeper after the applicant obtains the required town zoning approval. County zoning permits for unincorporated areas are issued by Culpeper County Planning and Zoning (540-727-3404).

Application Process

  1. Determine whether the project is in unincorporated Culpeper County or inside the Town of Culpeper limits. The correct zoning office depends on project location.
  2. Obtain a zoning permit first. County projects apply through Culpeper County Planning and Zoning; projects inside town limits obtain the town zoning permit from the Town of Culpeper Department of Planning and Community Development before proceeding to the county. Trade permits do not require a zoning permit.
  3. Assemble the county building permit package: completed permit application, zoning approval confirmation, health permit where applicable, construction plans and specifications, design criteria, and any applicable engineer or architect information and seals.
  4. Submit through the CivicGov Public Portal or by paper submission by mail or in person at 302 N. Main Street.
  5. Pay the non-refundable $75 administrative fee at submission. Remaining permit, plan review, and state levy amounts are calculated and invoiced by staff.
  6. Respond to any plan review comments through the CivicGov portal by uploading revised documents and notifying staff through the portal message system.
  7. After approval, receive the permit placard and approved construction documents. Post the placard visibly from a public way before beginning work.
  8. Schedule required inspections through the CivicGov portal or by phone at 540-727-3405. Next-day inspections must be requested by 2:00 p.m. the prior business day when workload allows.

Typical processing time: No general countywide processing-time guarantee was found for ordinary building permits. Qualifying SolarAPP+ rooftop solar permits have a less-than-three-business-day turnaround target.

General Requirements

Zoning permits are required for all building permits. The county building department requires a zoning permit from the applicable jurisdiction before building permit submission. Trade permits do not require a prior zoning permit.

Permit validity
Zoning permits are null and void if no action is taken within six months. Building permit applications are deemed abandoned six months after filing unless pursued in good faith or issued. An issued permit may be revoked if work does not commence within six months of issuance or is suspended or abandoned for six months. Inspections are required at six-month intervals as proof of continuance of construction.

Virginia Uniform Statewide Building Code (USBC). The county administers the 2021 Virginia code family, effective January 18, 2025.
Owner-builder
Property owners may qualify for Virginia Code section 54.1-1101 exemptions, including construction of no more than one primary residence for their own use during any 24-month period and certain immediate-family gift situations. If the owner obtains the permit under an exemption and later hires contractors, the owner remains responsible for ensuring proper licensure.
Contractor requirements
Culpeper County issues permits only to properly licensed contractors or persons exempt from the Commonwealth's contractor-licensing requirements. Contractor licenses are verified at permit application through DPOR, including applicable trade licenses. Jobs valued at $1,000 or more require the proper Virginia Class A, B, or C contractor license.

$100 per reinspection. After-hours inspection: $125 per hour with minimums. Pre-work inspection: $100.
Penalty (no permit)
$200 for working without a permit. Permit renewal after six months of no inspection activity: $25 per six-month period.
